| Acker vs. Robbins heard by Judge Holnes
At the afternoon session of the jury waifed Superior Court before Judge L. LeBaron Holmes yesterday trial was begun in the case of Hattie A. Acker vs. Alanson P. Robbins, administrator. The case was a suit in equity and concerned bank books alleged to be in the hands of the administrator. Daniel Manning appeared for the plaintiff and J. M. Cochran and E. A. D. Moss for the defendant. The plaintiff is a resident of Paxton. The respondents in the case were Alanson P. Robbins of Worcester, administrator on the estate of Elbridge Acker of Paxton, husband of the plaintiff, and five banks..... It is alleged that the books were in the name of Elbridge Acker and Hattie A. Acker. Elbridge Acker died Nov. 14, 1902. Shortly afterward Alanson P. Robbins was appointed administrator of the estate. It is alleged that the administrator falsely represented to the plaintiff that she should turn over the books to him and that she did so; that March 25, 1903, she demanded that he return the books to her. The plaintiff asks that the banks be restrained from paying over any of the money to the administrator and also asks that the books be returned to her. |
| Plaintiff entitled to Bank Deposits
In the case of Hattie A. Acker vs. Alanson P. Robbins et al, asking that savings banks in Worcester and vicinity be enjoined from paying over to the defendant as administrator of the estate of Elbridge Acker of Paxton, a decree was handed down by the Superior Court yesterday. The finding was that the plaintiff is entitled to the six deposits mentioned in the bill, and to recover in an action at law. |
